Media & Photographer Accreditation for the 2018 Brisbane Global Rugby Tens (Tournament)

Terms and Conditions

Duco Events are pleased to present these terms and conditions for media and photographer accreditation to access the Tournament (Accreditation). Access to the Tournament will only be permitted on agreement by applicants to comply with the terms of access described in this document. By applying for and accepting Accreditation, the Pass-Holder and the firm, company or organisation he or she represents (Principal) agree to comply with these terms and conditions.

  1. General Obligations

1.1 Accreditation passes for the Tournament are issued by and are the property of Duco Events. Duco Events may grant, refuse, suspend, withdraw, revoke or cancel Accreditation to or for any person (Pass-Holder) or Principal at any time in its sole and absolute discretion. Without limiting Duco Events’ rights, in the event of an alleged breach of the terms, it is anticipated that Duco Events and the accredited party will first make reasonable efforts to resolve the matter before any steps are taken by Duco Events to withdraw the Accreditation. If practicable (as determined by Duco Events in its sole discretion), Duco Events will notify Pass-Holder and an appropriate senior representative of the Principal with details of the alleged breach, and request rectification of such breach. If practicable (as determined by Duco Events in its sole discretion), Pass-Holder and/or Principal will be provided with a reasonable opportunity to rectify a breach after such notification. Without limiting Duco Events’ rights, any breach of these terms shall entitle Duco Events to suspend, withdraw, revoke or cancel Accreditation.

1.2 Pass-Holder must be employed by, or specifically supplying, a recognised rugby, sporting, or news service or publication. Both the individual Pass-Holder and the Principal agree to be bound by these terms.

1.3 Accreditation is for the sole purpose of reporting on the Tournament for the Pass-Holder’s respective media organisation and/or for editorial news-related purposes by third parties.

1.4 Accreditation is strictly non-transferable and non-assignable without the prior written approval of Duco Events, which it may withhold in its sole and absolute discretion.

1.5 Accreditation must be worn or displayed by the Pass-Holder at all times as a condition of entry into and remaining in any accredited area and/or other location prescribed by Duco Events. Pass-Holders must comply with directions from any official or representative of Duco Events or the Venue manager and the rules relating to Suncorp Stadium, Brisbane (Venue).

1.6 The Pass-Holder must behave in a respectful manner and must not cause offence to, or otherwise inhibit the enjoyment of other media, rights holders, players, teams or spectators.

1.7 Access to the Venue will be refused, and Accreditation removed, if in the opinion of Duco Events Pass-Holder’s behaviour negatively affects the public standing of the Tournament, any of the participating teams, the Venue, any of the sponsors or commercial partners of the Tournament, Rugby or Duco Events.

1.8 Pass-Holder must be over the age of eighteen when attending the Tournament.

1.9 Pass-Holder and Principal shall not cause or permit the use of any material recorded by the Pass-Holder to be used in any way, which may challenge, damage, prejudice and/or undermine the intellectual property rights of Duco Events and/or Duco Events’ commercial program relating to the Tournament and/or which may assist ambush marketing of the Tournament or a participating team to take place. For the avoidance of doubt, nothing in this agreement affects the intellectual property rights of any accredited Pass-Holder or Principal. In particular, these terms of Accreditation are not intended to be, or shall not be interpreted as, undermining editorial independence or preventing the exercise of journalistic practices including and not limited to reporting, comment, review and criticism.

1.10 Pass-Holder agrees that any non-public information he/she obtains by virtue of being accredited will only be used for bona fide news reporting and will not be used by any person for betting or other non-news reporting purposes in relation to the tournament.

  1. Content: Data

2.1 Subject to 2.2, Pass-Holder and the Principal may capture and publish Tournament data, information and statistics (produced by them) (Data) for supply to and publication in any news distribution platform including newspapers, magazines, periodicals and/or other printed editorial products and/or radio and television broadcasts, and websites that provide genuine news reporting or on news services to mobile devices.  For the avoidance of doubt, Data does not include any form of audio-visual, visual or audio recording of any part of the Tournament.

2.2 Pass-Holder and Principal agree that they shall not commercially exploit Data other than for bona fide news reporting purposes. Nor shall Pass-Holder or Principal supply Data to a third party where they reasonably believe such third party may commercially exploit Data other than for bona fide news reporting purposes.

  1. Content: Text

3.1 Subject to 3.2, Pass-Holder and the Principal may produce at the Venue and publish written material produced by them at Venue relating to the Tournament (Text) for supply to and publication in any news-distribution platform including newspapers, magazines, periodicals and other printed editorial products and/or radio and television broadcasts, and websites that provide genuine news reporting or on news services to mobile devices. Principal may also syndicate or distribute its Text for editorial use by third parties in the normal course of business.

3.2 Pass-Holder and Principal agree that they shall not commercially exploit Text other than for bona fide news reporting purposes. Nor shall Pass-Holder or Principal supply Text to a third party where they reasonably believe such third party may commercially exploit Text other than for bona fide news reporting purposes.

  1. Content: Photographs, Video and Audio

4.1 Subject to 4.4 and 4.5 the Pass-Holder and the Principal may take, publish and supply (provided such supply is in accordance with clause 4.5), still images taken by them within the Venue of the Tournament (Photographs).

4.2 Pass-Holder and/or Principal shall not, for commercial use or otherwise, take or produce at Venues, and distribute or transmit via any media or device, any moving image (or series of single still images capable of conversion into a moving visual image) or moving film of any aspect of any Event (Video) so taken or produced by the Pass-Holder or Principal, other than recording and/or transmitting Tournament media conferences or pre-tournament media opportunities at a tournament training venue, or otherwise with the express written consent of Duco Events. It is acknowledged that nothing in these terms and conditions is intended to limit any rights or entitlements that the Pass-Holder or Principal would otherwise have as a matter of law (including entitlements to use brief excerpts of the audio-visual feed produced by the exclusive host broadcaster or any recordings thereof where such use constitutes “fair dealing” under the Copyright Act 1968 (Cth).

4.3 Pass-Holder agrees not to record and/or transmit any sounds, commentary or verbal description of the Tournament (Audio) except for Tournament media conferences or with the express written consent of Duco Events.

4.4 Pass-Holder and Principal agree that Photographs shall not be used in any manner that falsely implies an endorsement or sponsorship of or with the Tournament or any of the participating teams and where the Principal is a news agency, or photographic distribution agency or newspaper syndication service, the Principal shall take reasonable steps to communicate this restriction to third parties.

4.5 Photographs taken in accordance with this clause 4 may be used in any news-distribution platform for the following Editorial Purposes: a. reporting news, sports and current affairs in newspapers, magazines, periodicals and other forms of print media; b. reporting news, sports and current affairs to television broadcasts, mobile devices or websites that provide genuine news reporting. Such photographic stills shall not be used in a manner to emulate broadcast video or other moving visual images; c. aggregated internal and/or external databases; and d. online photographic agency distribution websites for the purposes of sales/syndication in the normal course of business. e. Further, photographic stills must not be made available on a commercial basis for downloading / copying for wallpaper, screensaver or multimedia messaging services.

4.6 Principal may also use Photographs for the purpose of promoting its editorial coverage of rugby provided, however, that such usage does not falsely imply an endorsement or sponsorship of or with the Tournament or any of the participating teams.

4.7 Pass-Holder and/or Principal shall be responsible for obtaining all necessary third party consents in relation to the permitted use of any Photograph.

4.8 Photographs taken at or in relation to the Tournament must not be altered or adjusted other than in the course of the normal journalistic or editorial practice, such as cropping or manipulation for the purpose of formatting or superimposition of captions or headlines.

  1. Other provisions

5.1 Nothing in these terms of Accreditation affect the Principal’s rights under the Copyright Act 1968 (Cth). For the avoidance of doubt, the intellectual property rights of any accredited individual, organisation or publication are only affected to the extent expressly set out in these terms. Duco Events agrees that all copyright in material created by the Pass-Holder, including newspaper or news agency representative at Events will be owned by the Pass-Holder and/or Principal.

5.2 Pass-Holder acknowledges that he/she shall move in and around the Venue at his or her own risk and must act in accordance with the instructions of duly authorised representatives of Duco Events and the Venue manager at all times.

5.3 Principal agrees to indemnify Duco Events and its employees, officers and agents against any loss, claim, expense or damage to Duco Events or its employees, officers or agents resulting from a breach of these terms of Accreditation by Pass-Holder or Principal. Duco Events agrees to indemnify Pass Holder and Principal (and Principal’s employees, officers and agents) against any loss, claim, expense or damage to Pass-Holder or Principal (or Principal’s employees, officers or agents) resulting from a breach of these terms of accreditation by Duco Events.

5.4 These terms and conditions are governed by the laws of Australia. By submitting an application for media accreditation for the Tournament, the Pass-Holder and Principal acknowledge they have read, understood and agreed to these terms and conditions.
